Parents Win $1 Million After Child Killed By Postal Truck

Record Award for Minor in Tort Claims Act Case

In conjunction with counsel for the mother of the deceased child, we pursued a Federal Tort Claim against the U.S. Postal Service for the wrongful death of the child as well as our client's personal injuries.

The U.S. Postal Service must pay $1 Million to the parents of a 3-year-old Kansas City girl who was killed when a postal truck crashed into the apartment where she was sleeping.

Experts say the judgment, entered by U.S. District Judge Gary A. Fenner, may be the largest award to date for a death of a minor child in a Federal Tort Claims Act lawsuit.

At the same time, restrictions imposed by the FTCA limited the verdict, which would have been much higher had it been possible to try the case under the missouri wroungful death statute.
