I wasnt wearing a seatbelt during the crash. Do I still have an injury case?
In Missouri and Kansas, children are required to be buckled up in an appropriate child safety seat or seatbelt. However, adults are only covered by secondary seat belt laws. This means that adults can be fined for not wearing a seatbelt only if they are pulled over for another offense or are in a traffic accident.
If you sustained a serious injury in a car wreck, and it can be proven that the other driver was at fault, you may have a personal injury case. However, the lawyer for the at-fault driver may argue that your injuries would not have been as severe had you been wearing a seatbelt.
If your case goes to court, the judge and jury will have to determine which injuries would still have been sustained had you been a seatbelt. The at-fault driver will be liable for damages for those injuries, but may not have to pay for the injuries caused that could have been prevented by proper seat belt use.
