What is a personal injury?

A personal injury means an injury to the body, the mind or the emotions, rather than an injury to property. In common usage, it refers to a situation in which an individual's injury has resulted from the negligent acts or omissions of another person or entity. A personal injury can also be the result of intentional conduct. A personal injury also generally refers to a tort, which forms the basis or the allegations for a lawsuit. If the negligence of another person or entity can be proved, the person who was injured due to the negligence is usually entitled to monetary compensation from the responsible person or entity. Proving negligence and injuries and damages is often a complex process and the party who has sustained personal injury is only entitled to compensation once both liability and damages have been proved.
