  • All children under 4 years of age must be in a federally approved child safety seat.
  • Children who are over four years of age, but are not yet eight years-old, must be restrained in a booster seat or car seat unless they are over four feet and nine inches tall or weigh more than 80 pounds
  • Children who are over four feet and nine inches tall or weigh more than 80 pounds and are under age 14 must be restrained in a car safety belt.

The child restraint laws in Kansas do not completely reflect the new guidelines of the National Highway Transportation Safety Administration (NHTSA) and American Academy of Pediatrics (AAP). In Kansas, police may not stop a vehicle simply because the driver or passenger is not wearing a seat belt. If a driver or passenger is ticketed for a seat belt violation, the ticket must include the reason the vehicle was stopped. The fine for not buckling up is currently $5, but will be $10 after July 1, 2011.

A driver may be stopped if a child is not restrained. The fine for a child restraint violation is $60.
