Myth 10: The responsible party's insurance company will settle your claim because they will not want to pay what it would cost to take this case to trial.
In today's world most insurance companies have attorneys that are "in house" or work on on a fixed fee basis. Because of this, the insurance company generally knows it's cost to defend a case in advance. It has been our experience that the cost of litigating a case has little to do with the insurer's decision to settle or not settle a case.
Myth 11: The responsible party's insurance company will not take your case to trial because they do not want the publicity.
Although the insured may care about adverse publicity, the insurance company could care less. More importantly, unless the facts of your case are particularly bad, it will receive little if any press attention in most instances.
Myth 12: A jury will always see who is right and do justice/If we go to trial, we'll get more money from a jury.
As a result of the influence of anti-consumer, pro-big business and pro-insurance special interest groups, many people who may one day sit on a jury in an accident case have been misled into thinking that anyone who brings an accident claim is trying to get something for nothing. Those potential jurors have been largely brainwashed into thinking, that they should withhold fair compensation to injured accident victims because they feel our system is based on "jackpot justice" and the people routinely pursue "frivolous lawsuits." Because of these tendencies, it is vitally important to consider the advice of an experienced attorney to help you determine whether to accept a settlement offer or file a lawsuit and litigate your case.
Myth 13: You should be afraid to go to trial.
Although any lawsuit involves time, expense and uncertainty, there are many situations where suit is necessary. Often, the most effective way to obtain the best settlement offer from the insurance company is to fully prepare to go to trial, and to make the responsible party, their insurer aware that you are willing to proceed to trial. Although you may be nervous throughout the process, you will be fully prepared and there is never a reason to be afraid.
