Don’t Settle Your Injury Accident Case Before A Follow Up With Your Doctor

Don’t Settle Your Injury Accident Case Before A Follow Up With Your Doctor

Once an accident occurs, a representative from the insurance company sometimes known as an “adjuster” will try to contact you in a very quick fashion in order to try to “help” you reach a settlement. The general technique these representatives use is an appearance of concern for your well being and a hard working effort to get you compensated as quickly and properly as possible. What many people that have to deal with these representatives are not aware of is that a quick settlement is generally far more beneficial for the insurance company than it is for the injured party.

Often injuries that occur as a result of accidents do not present themselves until several days later, and if by that point a settlement has been reached with the insurance company there is absolutely no chance for the injured party to be compensated for the treatment of those injuries. Once such an accident case is settled it is sealed shut and will never be allowed to be opened again. Because of this, many trusting individuals that are forced upon a bad situation come out of the settlement with far less than their fair share of financial compensation for their injuries and are forced to carry the substantial financial burden on their own.

The generally advised way to proceed when an accident occurs is to follow through with all of the advised medical evaluations and treatments and make sure your injuries have properly healed before you ever consider or discuss settlement. It is also recommended to see your doctor for an examination following all of your treatments in order to become absolutely certain that no other injuries or complications have occurred and that no other medical care will be necessary as a result of the accident.

Another essential word of advice is to not attempt to terminate medical treatment earlier than necessary. Studies show that early and thorough treatment for injuries gives the injured person the best chance of being restored to pre-accident physical condition and health. Contrary to popular mythology, it has been our experience that rather than exaggerating an injury individuals will many times minimize their injuries, especially toward the end of treatment, in an effort to “move on with life,” notwithstanding significant ongoing physical problems due to the injury. Premature termination of medical care and treatment often has serious dual negative effect, resulting in a lack of sufficient medical treatment and therefore a sub-optimal physical recovery, and a failure to document the full extent of the injuries and disabilities which results in inadequate, oftentimes significantly inadequate compensation (emphasis added), for the injuries and damages sustained.

Don’t be fooled! ...

This recommended series of procedures may seem a bit extensive or overbearing, but without it an injured person leaves himself or herself vulnerable to further injury in the form of significant financial burden, which in turn can mean the inability to pay for medical treatment already incurred, additional required medical treatment in the future, the inability to replace lost past and future income, and more.

In summary, once an injury case is settled with the opposing party’s insurance company it is generally over, and due to a distinct possibility that further injuries may surface many days after the accident, any injured party is highly advised to complete all treatments and visit their doctor before finally deciding to attempt to settle their injury claim with the insurance company. Patience is key when it comes to injury cases and it is highly likely that proceeding with caution, and not submitting to a fast, cheap dollar at a time when there may be a temptation to due so due to the financial strain caused by the injury and the inability to work, will yield far, far better results for the injured party.
