Head injuries at birth: When are Kansas City birth injuries the result of medical malpractice?

In most births the head is the first part of the infant’s body to enter the birth canal, so even normal births may result in trauma to the baby’s head or brain. It is not uncommon for a baby to have bruising or swelling of the face and head for the first few days after birth. These are some common injuries:

Cephalohematoma – A cephalohematoma is a word describing an area of bleeding under one of the bones of the skull. These areas appear as raised lumps on the baby’s head, but the body reabsorbs the blood. The cephalohematoma disappears completely within a few months.

Nerve injuries to the face – Forceps can put pressure on the nerves in the baby’s face. The pressure can cause an injury that leaves the muscles on one side of the face weak. When the baby cries the injuries will make his face appear asymmetric or lopsided. If the nerve is bruised, the baby may not be able to completely close one eye. However, in most cases, the newborn will recover without treatment within a few weeks. In rare cases, the nerve may be torn and the newborn will require surgery in order to heal.

Hypoxia brain injury / Anoxia brain injury – Hypoxia occurs when the amount of oxygen going to the brain is reduced. Anoxia occurs when the brain is completely deprived of oxygen. The loss of oxygen can result in death, blindness, learning disabilities, behavior problems, developmental delays, mental retardation or cerebral palsy.

Some preventable causes of infant brain injuries:

• Delayed delivery resulting in decrease of oxygen to the brain
• Failure to perform a timely C-section
• Complications during a vaginal birth after a C-section (VBAC)
• Dangerous drug interactions
• Wrong dosages of drugs or other prescription mistakes
• Improper delivery methods
• Infant is caught in birth canal for long period of time
• Failure to monitor the baby for signs of distress
• Failure to promptly diagnose or treat birth injuries or infections
• Trauma during delivery

Brain injuries are expensive and require long term medical treatment and on-going care. The financial burden can put stress on a family. If your child experienced a brain injury due to any of the medical mistakes listed above, your may have a Missouri medical malpractice claim. You may be entitled to compensation for your child’s medical care, therapy and related expenses.
