Injured on-the-job: How do I know if my Kansas City employer carries Workers’ Compensation insurance?

Workers' compensation is an insurance plan provided by the employer to pay employee benefits for job-related injuries, disability or death. Workers' compensation is mandated by state and federal laws. The rules requiring workers' compensation coverage vary by state.

Missouri

In Missouri, all employers with five or more employees are required to carry Missouri workers’ compensation insurance. However, because construction work is so dangerous, in the construction industry, Missouri employers must carry workers’ compensation insurance if they have one or more employees.
The exceptions in Missouri include, railroad, postal, and maritime workers are covered under federal laws and not by Missouri Workers’ Compensation Laws.

Other exceptions include:

Farm labor
Domestic servants in a private home
Occasional labor performed for a private home
Some real estate agents and direct sellers who qualify as independent contractors
Volunteers who are not paid wages
Self-employed workers

Kansas

In Kansas all employers with a gross annual payroll of $20,000 or more must carry Kansas workers’ compensation coverage. All payroll is taken into account, including that paid to workers out of state. An exception is made if the employer is a sole proprietor or a partnership, and then the wages paid to the owners and any of their family members are not used in the computation of the gross annual payroll.

Employment categories excluded from the law are:

Certain agricultural and farm employees
Realtors who qualify as independent contractors
Firefighters belonging to a firefighters relief association which has legally waived workers compensation coverage
Certain owner-operator vehicle drivers who are covered by their own occupational accident insurance policy

In both states, employers that are not required to carry workers’ compensation coverage may decide to carry workers’ compensation insurance as self-protection. Exempt employers that do not purchase workers compensation insurance may be sued by employees who are injured while at work.

Workers' Compensation In Kansas and Missouri

Under workers' compensation, employees who are injured by a job-related injury or disease are entitled to:

Payment of medical benefits to treat the job-related injury or illness
Payment of income benefits to replace part of the wages lost due to the injury or illness
If a death results from a job-related injury or disease, then benefits are paid to surviving spouse, dependents or heirs.

If an employee is injured and the company does not carry workers’ compensation insurance, then a personal injury lawsuit can be filed against the employer. If it can be proven that the injury was caused by the company’s negligence, the employee may recover medical bills, lost wages, pain and suffering and other damages.
