What Will Happen if Kansas And Missouri Don’t Comply with New FMCSA Safety Regulation?

The Federal Motor Carrier Safety Administration (FMCSA) is calling for all states to require interstate truck drivers to provide proof that a health professional has found them healthy enough to drive. Without such proof, the FMCSA is requiring states to deny potential truck drivers commercial driving licenses. The deadline provided by the FMCSA to the states for this requirement is January 30, 2012. Missouri and Kansas do not anticipate being able to comply with this requirement by that date and serious safety consequences may follow.
A Kansas City Truck Accident Lawyer Explains the Possible Ramifications of Noncompliance in Kansas And Missouri
The potential safety ramifications of not complying with the FMCSA regulation are significant. First, there is the obvious consequence, not all interstate truck drivers will get a physical and provide proof that they are healthy enough to drive a truck. Health is an important job qualification because a truck driver who has a medical emergency behind the wheel may lose control and cause an accident.
Next, the federal government could impose penalties for noncompliance with this regulation. Specifically, the government could lose 5% of their federal highway funds, an amount equal to tens of millions of dollars, during the first year of noncompliance. That amount could double during the second year of noncompliance. It is currently unclear whether the financial penalties will be imposed immediately or whether states will be given a grace period before enforcement. Loss of federal highway funds could affect a state’s ability to make needed safety repairs on its roads.
