Every year, more than 3,000 U.S. Postal Service mail carriers are attacked by dogs across the United States. But, mail carriers aren’t the only victims of on-the-job dog bites. Delivery persons, repair men, newspaper carriers, meter readers, utility workers, census workers and landscapers are also at risk of on-the-job dog bites.
If you were injured by a dog bite or dog attack while on the job in Kansas City, there are two ways to collect damages.
1. If the injury occurred as a direct result of your job duties, you may be to file a Missouri workers’ compensation claim.
2. You may be able to file a dog bite lawsuit against the owner of the dog or owner of the property.
Anytime, you are injured as a direct result of your work duties, your employer is usually responsible for paying for your medical bills and a portion of your lost wages. This is true in most cases regardless of who is at fault for the injury. Worker’s compensation law prevents an employee from filing a personal injury lawsuit against his employer, but it does not prevent the employee from filing a personal injury claim against any third party that is wholly or partially responsible for the injury.
Third-Party Dog Bite Lawsuits
Dog bite law varies from county to county. In Missouri, a dog owner may be held strictly liable for any injuries his dog inflicts. This means the dog owner is accountable for any dog bites or dog attacks, even if the dog has never bitten before and has never shown aggressive tendencies. The only exception is if the dog bite victim provoked the dog or was trespassing on the dog owner’s property. If you are working, chances are that you have the permission of the dog owner or of the landlord to enter the property.
Dog bite injuries can be very serious. Victims suffer not only physical injury, but psychological trauma as well. If you were bitten by a dog while at work, you deserve compensation.
