Kansas City Slip and Falls: Serious Accidents And A Leading Cause of Wrongful Death

Slip and fall accidents kill more than 16,000 Americans each year. In fact, injuries caused by slipping and falling are the second leading cause of accidental deaths, ranking behind only automobile accidents. Falls are the leading cause of accidental death for the elderly. More than 11,000 of these deaths occur to Americans over the age of 75.

Sometimes slip and falls occur for no reason. The victim was clumsy or chose to wear shoes that weren’t suitable for the chosen activity. But, many slip and fall accidents are due to negligence. They occur because of a hazardous or dangerous condition that could have been prevented.

Wrongful death is a legal term used to describe a death that results from a wrongful act or from the negligence of a person or business.

Businesses and property owners have the legal responsibility to minimize the risk of accidents occurring on their property and to ensure the safety of those who visit. Businesses, such as nursing homes, that cater to the elderly should be especially vigilant.

A landowner or business owner may be responsible for a death resulting from a slip and fall on their premises if the fall was caused by a hazardous or dangerous condition and if the owner had previous knowledge or should have had previous knowledge of the condition. Examples include permanent conditions such as uneven steps or broken flooring or temporary situations such as a spilled drink or burnt out light bulbs.

When determining fault in a slip and fall accident, one must consider whether the hazard or dangerous condition was obvious; how long the condition existed prior to the slip and fall; whether the property owner used reasonable care in maintaining the premises; who caused the hazard or dangerous condition; and whether there was a sign or other warning of the hazard or dangerous condition.

When wrongful death occurs, the surviving family members of the accident victim may be able to collect compensation for their loved one’s injury and for the family’s loss. Wrongful death damages include any expenses related to the injury that led to the death. These expenses may include lost earnings and medical bills, as well as the pain and suffering the deceased may have suffered between the onset of injury and his death. These damages are known as “survival damages” because had the deceased survived the accident, he could have recovered these losses with a Missouri personal injury claim.

In addition to survival damages, family members may receive compensation for pecuniary loss, funeral expenses, and for the reasonable value of the services, consortium, companionship, comfort, instruction, guidance, counsel, training, and support that the deceased loved one provided to the family.
