Bicycle accident: Do's and dont's if you are involved ...

What To Do In Case Of A Bicycle Accident

  1. Always carry a cell phone, some personal identification, an emergency contact, and a pen.
  2. Do not move your bicycle (leave it in the location and condition it was immediately following the accident until the police have had an opportunity to investigate, as long as it is not causing an immediate safety hazard).
  3. Call the police and emergency medical services immediately (or ask someone for assistance if you are unable).
  4. Exchange information with the other parties (obtain drivers license number and insurance information).
  5. Do not discuss fault or make statements to anyone but the police.
  6. Remain on the scene and file an accident report to document the facts of the incident, the identity of the parties, and any witness information.
  7. If you are injured, tell the police.
  8. Obtain contact information from the police officer.
  9. Obtain identifying information from any eyewitnesses to the accident.
  10. Take photographs of the accident site and any vehicles involved.
  11. Seek immediate medical attention at the scene of the accident and immediately thereafter at emergency room. Even though injured, many people do not go to an emergency room because they do not think their injury is serious enough and because of cost. Under the stress of the moment, it is impossible to clearly determine the nature and extent of any injury. Additionally, some injuries are not immediately apparent and only become symptomatic within a few hours of the accident. For you own safety and well being, get checked out, even if you do not believe the injuries are serious. Also, most insurance adjusters feel that unless someone goes to a hospital they must not have been hurt in the accident. Give all complaints to the doctor. Medical records are proof that you were injured and document the extent of your injuries.
  12. Do not give statements to insurance adjusters before obtaining legal advice.
  13. Do not give statements to insurance adjusters before obtaining legal advice (see our website article concerning giving recorded statements to an insurance adjuster).
  14. Do not discuss the accident with insurance adjusters until you talk to a lawyer.
