A nursing home resident has the right to be fully informed about all care and treatment affecting the resident’s health and well-being.
The resident has a right to inspect and purchase copies of all medical, care and home records pertaining to the resident. Records must be provided within 2 business days.
The resident has the right to make healthcare decisions, including the rights to:
•Choose a physician
•Refuse treatment
•Refuse to participate in experimental research
•Choose a pharmacy
•Self administer drugs
•To leave or check out of the home
•To receive notice of changes concerning physical, mental or psychosocial status, treatment plan, medical care, transfer or discharge, and room or roommate changes.
A resident has the right to personal privacy and to the confidentiality of personal and medical records.
A resident has a right to be free from restraint.
A resident has a right to be free from abuse, neglect or exploitation including verbal, sexual, physical, or mental abuse, fiduciary abuse, corporal punishment and involuntary seclusion.
A resident has a right to retain personal possessions.
A resident has a right to share a room with a spouse.
A resident has a right to choose or refuse to perform services for the home.
A resident has a right to participate in resident groups and to meet with other residents and their families.
A resident has the right to participate in social, religious and community activities.
A resident has the right to receive and send mail and to regular access to the private use of a telephone.
A resident has the right to communicate with visitors in privacy.
Family members, attending physicians, and certain state officials have the right to immediate access to the resident.
A resident has the right to reasonable accommodation of individual needs and preferences except when the health and safety of the resident or other residents would be endangered.
A resident has the right to voice grievances with respect to treatment or care without discrimination or fear of reprisal. A resident has the right to expect the nursing home to resolve grievances, including those regarding the behavior of other residents.
A facility must post contact information for pertinent government and advocacy organizations and it must allow residents to contact those organizations.
The resident has the right to contact the Long-Term Care Ombudsman (Kansas 1-877-662-8362 or Missouri 1-800-392-0210) for with concerns related to the nursing home.
The facility must notify the resident and the resident’s family 30 days before a transfer or discharge takes place. They must record the reasons in the clinical record. The patient has the right to appeal the transfer or discharge to the state through the Long-Term Care Ombudsman.
