That's how the contingency fee works and that is what opens the door to the courthouse for most seriously injured people. Contingency fees contract have sometimes been referred to as the poor man's key to the courthouse because people who have been seriously injured often can't work and can't afford the significant expenses it takes to bring a personal injury claim to trial. These claims can be very expensive, with costs such as hiring medical experts, getting medical reports, filing fees, and paying court reporters typically ranging from $5,000 to as high as $100,000 or more depending on the type of case. Lawyers put up their time and their money in the hopes of a good recovery. When you get a good personal injury attorney, you're partners with him because his fee depends on his recovering on your behalf and you don't have to pay him any money up front. Your attorney lays out all the costs and expenses throughout the course of your case. It is only if the lawyer is successful getting compensation that he gets paid meaning that his fee is contingent. He only gets a fee if he is successful getting you money.
... But What About Expenses ...
So the contingency fee means that your lawyer gets a fee only if he recovers money for you. But what happens if your lawyer is not successful? Sure, you don't have to pay him a fee for his services. But do you still have to pay him back for the expenses that he advanced on your behalf?
Your attorney may incur $5,000, even $100,000 in expenses while pursuing your case. After losing a case, some attorneys will ask to be paid back for these expenses incurred. I'm pleased to say that in the 19 years that I have been in practice, I have never asked to be reimbursed for my expenses incurred in the rare event that we have not recovered for a client. If you're considering hiring an attorney, you should ask if he has ever failed to recover on behalf of a client and if so whether that client had to pay him back for his advanced expenses. If he says he has never failed to recover, I would strongly question whether he has much experience litigating cases because its highly unlikely that very good attorneys with a lot of litigation experience have never suffered at least one loss.
