The accused, John A. Tinkler, has been charged on three accounts: child endangerment, second-degree manslaughter, and second-degree murder. Who is the alleged victim? A three-year old girl.
The little girl's mother, Gloria Sandercox, asked her boyfriend to babysit her five children, including the victim. During that time, emergency officials received a call from Tinkler. He tried to explain to the police that he thought the little girl was taking a bath when she suddenly fell and injured her head. But Tinkler also elaborated on why he thought she had fallen. He told police that the little girl had been cranky, and during her afternoon nap, she had vomitted up all of the food she had eaten for lunch. Because the little girl allegedly vomitted, Tinkler took her to the bathtub to bathe her. But instead of staying with her, he went to go watch a documentary on television. Tinkler claims that when he returned, the little girl was stumbling around when all of a sudden she fell. From that point on, he claims she was unable to respond to him, and that is when he decided to call police.
Here are the inconsistencies.
1. When Fire Captain David Paul arrived at the scene, he noted that he was instantly suspicious. The little girl appeared to already be deceased, but it did not seem like she had been bathed.
2. Captain Paul also noted that the little girl had a visible bruise on her on her stomach, not her head, and this bruise continued to grow larger and worse.
3. Autopsy results indicate that the little girl's bruise had to have been sustained almost immediately prior to her death.
4. In addition, autopsy results show and the Assistant District Attorney, Jessica Hall, who is handling this case point our that the bruising does not appear to be accidental or consistent with child-to-child injury.
5. The cause of death was finally determined to be a fatal blow to the abdomen which is consistent with another human being punching or kicking the little girl.
So what's left? Tinkler's attorney is claiming that this incident was probably caused by another child earlier in the day. The defense brought up the fact that there is play equipment and some tree stubs in the backyard that could have caused this injury instead. The defense's theory is built around the alleged idea that the little girl "played hard." But juxtaposed next to all of the district attorney's and the coroner's office, this claim becomes contradictory.
