Drunk drivers in Missouri will face stiffer penalties with new laws that go into place on August 28th. The laws will impact both the first time offenders as well as persistent offenders. First time offenders in Missouri will almost certainly face jail time and all offenders will be placeed in a central data base that will be available to all judges and law enforcement agencies in the state. The central data base was designed to prevent drivers with multiple DWIs from working the system to avoid significant penalties.
These new policies will certainly help make Missouri streets safer, but the new laws also involve a tremendous amount of paperwork for law enforcement and the prosecutors office. Of course that paperwork will also impact the cost to defend individuals with DWI or DUI charges. It has been estimated that a DUI that used to cost an individual around $3,000 in court costs, attorney fees and increased insurance rates will now cost between $6,000-$8,000.
The new laws focus is primarily on DWIs with no property damage or injuries. First time offenders may get probation and diversion, unless their Blood Alcohol Concentration (BAC) approaches twice the legal limit. Under the new laws, if an offender blows a .15 or greater BAC, they are no longer eligilbe for probation.
The data base will also include past offenders. The state has directed all agencies to enter every DWI they have records for into the new system.
