New Kansas Law Drops Single DUI Offense after Ten Years

Repeat drunk driving offenders in the state of Kansas may be catching a bit of a break. A new law that took effect as of July 1, 2011 states that DUI convictions prior to 2001 will no longer be used to determine your sentence, something the Johnson County District Attorney says is a major setback for prosecutors across the state.

"What that means to prosecutors and law enforcement is that if you have prior DUI's outside of a ten year period, even two or three, won't be able to enhance that punishment in the sentence. This is a huge impact as far as penalties on professional drunks," said Johnson County District Attorney Steve Howe.

The law enables those who have made efforts over a ten year period to wipe the slate clean.

Howe said in the past, the state of Kansas had a good track record for being strict on DUI offenders and hopes this new law will be reversed.

"I think it's a step back in eyes of most prosecutors, something we hope to undue in the next legislative session," said Howe.

When it comes to the penalties from the state, officials are going to look at all DUI's on a person's record to determine how long they should lose their license.
