Parents of KU student sue fraternity over drinking death

Parents of a University of Kansas freshman who died while at the Sigma Alpha Epsilon house last March have filed a wrongful death lawsuit against the fraternity.
The parents are seeking $75,000 in damages and have pledged to use a percentage of the award to educate KU students about the dangers of alcohol and hazing.
Nineteen-year-old Jay Wren was a resident at the fraternity house when he died in his bed on March 8, 2009. Wren had started drinking pitchers of margaritas at dinner and continued binge drinking beer and whiskey until the morning hours. An autopsy found that he had died of alcohol poisoning.
The lawsuit alleges that at least ten people are responsible for Wren’s death. It also alleges that:
• The fraternity violated an agreement made with Wren’s parents stating that underage drinking was not permitted in the house and that drinking games were banned.
• On the night before Wren’s death “beer pong games were set up and made available to underage individuals.”
• Pledges were challenged to “man up” and drink large quantities as part of the games.
• Wren suffered a head injury.
• Fraternity members failed to assist with medical attention despite an obvious need for medical help.
• Nineteen chapters of Sigma Alpha Epsilon have been disciplined for alcohol-related violations.
KU does not allow underage drinking, but because the fraternity is off-campus, KU officials had jurisdiction over alcohol violations.
