In Colorado, John Ortega has been formally charged on 21 counts for tasering students of Lake County, Colorado. Eleven of those counts were for child abuse causing injury, but one was for child abuse not causing injury. The last nine counts were for reckless endangerment. In actuality, it is reported that at least 34 children were tasered in total, but some chose not to file suit. If Ortega is found guilty on all counts, he could be facing up to 27 years in a county jail.
The incident occurred on April 8th at a high school career fair. The accused alleges that the children were actually asking to be tasered, and for awhile he declined doing so. However, some of the children told Ortega that they would be willing to sign hold-harmless forms, and that is when Ortega agreed. At this time, no evidence is available to show that any forms were signed. What Sheriff Deputy Ortega did not know, was that several of those students actually suffered from heart problems, and the tasering was actually endangering their lives. Fortunately, only two of the students sustained minor burns.
Ortega was placed on a week long suspension without pay, but four days after the incident occurred he resigned from his position.
The taser used featured the "drive-stun technique." Normally, tasers shoot a pair of small, dart-like objects that are attached to wires and provide an electrical shock. But the special feature on Ortega's taser did not use the darts, and was able to shock the children without wires. These devices cause excruciating levels of pain, and it is believed that the taser used in this incident was aimed at the children's legs.
Mark Hurlbert is the district attorney who is charging Ortega, and has made it very clear that he believes Ortega acted "foolishly."
