Slip and Fall Injuries: Are You or Your Loved One A Slip And Fall Victim Of ...

What is a Slip and Fall?

If you live in Kansas or Missouri and have an injury resulting from a slip and fall on another person’s property, such as a home or a business, you may be able to recover monetary compensation for your damages if the property owner was negligent.

A slip and fall accident occurs when a person slips and falls, trips and falls, or steps and falls because of an existing dangerous condition or a hazard in their path. There are many causes of slip and fall accidents: poor lighting; liquid spill; hidden hazard (i.e. small gap or hole in ground or floor); and uneven floor or walkway.

A landowner or business owner may be responsible for an injury resulting from a slip and fall on their premises, if the fall was caused by a hazardous or dangerous condition and the owner had knowledge or should have had knowledge about the condition. The condition could be permanent such as uneven concrete on the walkway or temporary such as a grape in the aisle of a supermarket.

A slip and fall lawsuit is considered a tort case. This type of tort case is a premises liability case and is brought against a property or business owner when they are negligent. This can happen when a property owner has knowledge of a hazardous condition and did nothing to correct or remove it and a person slips or trips and falls and sustains an injury.

When determining fault in a slip and fall accident some things should be considered, such as whether the hazard or dangerous condition was open and obvious; how long had the condition existed prior to the slip and fall; whether the property owner used reasonable care in maintaining the premises; who caused the hazard or dangerous condition; and whether there a sign warning of the hazard or dangerous condition.

As a defense property owners generally argue that they were not at fault or that the injured person was at fault. These defenses are typically used when a condition may have been caused just prior to the slip and fall or they may claim that a person should have seen the condition if they had been watching where they were walking. In any slip and fall or trip and fall case you must consider whether your own actions caused or contributed to the slip and fall.
